Parliament Is To Discuss and Make Laws but Not to Discuss Criminal Cases Against Ministers


Duty of Parliament is to plan for growth of the country, to make laws and policies, to frame rules for smooth functioning of the administrative machinery, to review execution of laws and rules, to guide and monitor the performance of state governments etc and it is the function of judiciary to look into pros and cons of cases of corruption, fraud or any financial irregularities.

Obviously if a report is submitted by investigating agencies like CBI or CAG or ED or IT which contains allegation of irregularities, fraud , manipulation , corruption etc against ministers or MPs or any government department, it is not the duty of Parliament to discuss its validity or genuineness of the report.

It should be only the judiciary to take cognizance of valid points and order punishment to the real culprit. BJP is rightly demanding resignation of Manmohan Singh who is responsible for alleged loss in coal mines allotment case and it was Manmohan Singh only who being the cabinet head was accountable for financial loss caused to the nation in 2G spectrum cases. There is no justification in insistence of Congress Party to discuss CAG report in Parliament. If they real treat Parliament as temple of democracy they should use Parliament only for framing and reviewing laws and not waste time in mutual mudslinging process with a malicious intention to close the chapter of corruption .

I am unable to understand why the government is putting blame on BJP for not being ready to discuss the CAG in Parliament .Nothing happened even after prolonged debate on CWG or 2G scam in Parliament. It was lastly Supreme Court which forced the government to respond positively on charges of allegation leveled against Kalamadi or A Raja and others.

If Manmohan Singh is alleged to be fraud perpetrator or involved in crime committed in coal mines allotment case as per CAG report, he or his government do not have any moral right to discuss and debate the same in Parliament .After all CAG is a Constitutional authority and it is the moral duty of ruling party to respect the Constitutional authority and should not indulge in maligning the authority .If spokesmen of Congress Party like Manish Tiwari is allowed to humiliate Binod Roy , CAG ,it proves that they do not have any respect for democratic principles but they are inclined to conceal their crime and befool innocent Indians in the name of democracy.

If the ruling UPA still insists for debate, they are misinterpreting the spirit of democracy and rather destructing the temple of democracy called as Parliament. I reiterate that it is the duty of Judiciary not the Parliament to verify the genuineness of loss caused to the Government due to irregularities in Coal Mines allotment case and it is the duty of court only to fix the responsibility of the real culprit and award punishment.
