Criminals Do Not Fear Law


Over 43L cases pending before high courts

NEW DELHI: The wait for justice is likely to be longest if you file a court case in Uttar Pradesh or Tamil Nadu. There are 10 lakh cases pending before the Allahabad high court followed by 4.7 lakh cases in Madras HC.The Allahabad HC suffers from the double whammy of having the highest number of vacancies of judges as well. Of the 262 judges required in the Supreme Court and HCs across the country, 74 vacancies are in Allahabad.
Data given in response to an RTI application filed by Uttar Pradesh resident Kush Kalra showed that 43.22 lakh cases were pending before the country's high courts as on December 2011. Incidentally, the government in a Parliament reply had admitted that there were 3.2 crore cases pending before HCs and subordinate courts across the country last year.
The law ministry said the total approved strength of 21 high courts and the Supreme Court was 895.
There were 262 vacancies, led by Allahabad HC with 74 followed by 27 in Punjab and Haryana HC and 18 in Bombay HC. The SC has four vacancies for judges against an approved strength of 31 positions as on July 2012. Other states with high vacancies include Andhra Pradesh (16),Himachal Pradesh (13) and Delhi (12).
Incidentally, the US has a total vacancy of 77 positions in all its courts including the courts of appeal, district courts and courts of international trade.
According to information given by the law ministry as on December 2011, of the 43.22 lakh cases pending before all high courts, 33.69 lakh were civil cases. High courts with the highest number of cases before them were Allahabad with 10 lakh cases, Madras with 4.6 lakh, Bombay with 3.6 lakh and Calcutta with 3.4 lakh cases.
The government recently approved setting up of 'National Mission for Justice Delivery and Legal Reforms' that is aimed at increasing access by reducing delays and arrears in the system and enhancing accountability through structural changes and by setting performance standards and capacities. However, the impact of this project is still to be effectively felt.

My Comment:

Criminals do not fear Law. In other words Judiciary and Police officials do not have will to guarantee justice in shortest period of time and neither do they have courage to take against high profile criminals.

It is bitter but the truth for this country that Criminals rather remain in peace if the victim files a case in court of law or lodges FIR in police station to seek justice. Because once the case is lodged in any court or FIR is lodged in police station it is very easy for criminals to buy the police officials or magistrate or judges through various brokers working for this purpose. This is why cases are not decided in courts for years and decades and this is why no action is taken by police officials on FIR lodged by aggrieved person or group.

It will not wrong to say that criminals in nexus with politicians use judiciary and police system to perpetuate their profession of crime freely and fearlessly.

Advocates in greed of money play vital , pivotal and effective role to rape justice. Politicians, ministers and powerful officials provide indirect protections to all evil doers and help them in getting acquitted and exempted from punishment. 

It is not astonishing that everyday hundreds of rapes are carried out and rapists are seldom punished. In fact it is not only woman but entire humanity is raped everyday in our country. Honest and innocent persons cannot dream of justice from any office and any court of the country. 

Common men think it is always wise to bear with torture arising out of corrupt system  and it is always better and safer to swallow the poison of injustice rather than voicing his or her sound in any police station or in any court and then wasting valuable time and money for years and decades in want of justice. It is an old saying that ‘Justice delayed is justice denied’. Obviously it is wise to tolerate injustice than to spoil entire life in running from pillar to post in search of justice.

Politicians misuse judiciary, police officials, IAS officials , CBI and all law enforcing agencies to serve their self interest . They build pressure on all executive officers to obey and act upon ill motivated orders of powerful politicians or else be ready to face torture of frequent transfers and rejection in promotion process.

Whoever dares speak against the evil system is tortured by the gang of corrupt officers. Persons like Arvind Kejriwal , Ramdeo Baba, Bal Krishna and Anna Hazare and their team are humiliated and tortured by the system and political criminals . On the contrary person like Lalu accused of Chara Scam is made Railway minister. Corrupt ministers are made Governor of a state or Director in a public sector undertaking and even President of India without any feeling of shame or hesitation. Law Minister accused of misuse of government fund is made Foreign minister. 

This is India were corrupt officers are promoted year and after and elevated to highest post of the organization and honest and sincere officers like Khemka are transferred to remote places.

 This is why ninety nine percent of government servants are not performing for common men . They are mostly busy in keeping their bosses happy. They spend all their precious time in flattery to powerful top officials and ministers and powerful politicians whoever is in power. Officers and babus spend entire energy in extending personlised services to higher bosses sacrificing the interest of common men , consumers and customers. They may hang attractive banners and hoarding for excellent customer service but never try to put this ideal into action.

Flattery and sycophancy has become the key of best career. Politicians are busy in keeping their high command happy so that he may get ticket in election and if there is no winning possibility , he or she may get chance of becoming head of any government department or high power body.

In brief flattery and flattery is the only key for success in life. There is complete paralysis in executive only because performance is o where respected and honoured with promotion. Merit is not valuable and precious as much as flattery and closeness of bosses and ministers is. When ninety percent of government servants are corrupt it is always desirable to keep police department, investigating agencies , law enforcing agencies and finally the judiciary weak and incompetent. 

As long as Indian leaders are unable to create awareness of law and fear of law , Indians cannot and should not expect justice from any office or department.

दिल्ली में हुई बलात्कार की घटना (दिनांक -16.12.12) के बाद 1978 याद आया. केंद्र में पहली गैर कांग्रेसी सरकार बनी थी, 1977 में. जनता पार्टी की. हमारी पीढ़ी युवावस्था की दहलीज पर पांव रख रही थी. बेचैन और एक बेहतर वैकल्पिक व्यवस्था की चाहत लिये. उस सपने के प्रतीक, जेपी जिंदा थे. तभी दिल्ली में एक घटना हुई, जिसने पूरे देश को झकझोर डाला. तब न टेलीविजन थे, न मोबाइल, न इंटरनेट. पर कन्याकुमारी से कश्मीर तक और अरुणाचल से गुजरात तक देश बेचैन हुआ.
रंगा और बिल्ला नाम के दो अपराधियों ने दिल्ली मे ही एक लड़की के साथ बलात्कार किया. बचाने आये उसके भाई की हत्या कर दी. पूरी संसद बेचैन. जनता पार्टी में नयी व्यवस्था का सपना लेकर आये नये शासक (जनता पार्टी की नयी सरकार-सांसद) बेचैन. तब से दिल्ली में हुई बलात्कार की इस घटना (दिनांक - 16.12.12) के बीच क्या फर्क आया है? लोकतंत्र में केंद्र सरकार सर्वोपरि है. संसद सर्वोपरि है. रंगा-बिल्ला के प्रकरण के बाद संसद में हुई बहस (1978) पलट लीजिए. तब सरकार में बैठे लोगों के बयान पढ़ लीजिए.
